Benois Brasseur is listed as Bennett Brasseur and as a son of Robert Brasseur in a land patent to Robert that was filed on 12 April 1653 (Deed Bk 3, p. 33 in the Virginia Land Office). As a teen aged youngster, Benois/Benjamin came to America from Kent Co, England with his father. Benois later paid the passage for Mary Richford to come to America. It seems reasonable that this Mary was the Mary who became his wife.

Benjamin moved from Nanesmond Co, VA to Calvert Co, MD with his father when they left Virginia to escape harassment by the Anglicans, and to get better farming land.

Upon arriving in Maryland, Lord Baltimore gave Benjamin and each of his children 50 acres between 1658 and 1677 as a reward for moving to Maryland. A citizen could claim land in one Colony and move to another Colony and stake another claim. The claims for Benjamin and his children are found in Deed Bks 6 and 15. All but two are in Deed Bk 6.

In 1658, thinking Bennett's ownership was without dispute, Benjamin purchased an 1150 acre plantation from Richard Bennett and settled on the upper part of the land which overlooks Chesapeake Bay. The area was knows as the "Cliffs". A house, barns, livestock and slaves came with the property. The property line began at the south side of Chesapeake Beach and included the area currently known as Randle Cliff Beach as well as about half of the present-day U. S. Naval Base. The house was a clapboard and brick house overlooking Chesapeake Bay on the highest point in Calvert Co., MD, that was used as a residence until it burned in 1991. A modern addition was added to the house, and the original house was covered with siding before it burned. The original house was two 22' square rooms with a 12' x 22' breeze way between the two rooms. The upstairs consisted of two large rooms with four dormer windows. A porch on the Chesapeake Bay side of the house was added later.

Richard Bennett had the property surveyed in 1651 and closed the purchase in 1658 shortly before he sold it to Benjamin Brashear. The purchase contract still had not been finalized when Benjamin Brashear died about five years later. He felt he was not getting a deed to all of the land he had purchased. Benjamin's wife Mary finalized the purchase of the property from Richard Bennitt of Virginia for 220 hoggsheads of tobacco after Benjamin's death.

Benois Brasseur's name has been spelled as Bennett, Benois, Benoir, Benjamen and Benjamyn in early records. He gave his name the English spelling of "Benjamin Brashear" about the time he was given citizenship in the New World on 4 Dec 1662. He died shortly after becoming a citizen.

Whereas, Benjamin Brasseurs, late of Virginia, have sought leave to inhabit as a free Denizen, to purchase lands, I do hereby De Clare that said Bendjs. Brasseur, his wife and children, to be full Denizens of this our Province and that he be held, treated, reputed and esteemed as one of the faythfull people. - Celius Calvert

Mary remarried soon after Benjamin's death. She made a will naming her eight children as heirs at the time she married Thomas Sterling (Maryland Hall of Records, Will Book 1, pp. 187-89, 25 May 1663). Apparently he agreed to be stepfather to the children without any hope of inheriting any of the estate should Mary precede him in death. Mary apparently was a shrewd business woman, as she was able to give land to her children as they matured.

Whereas by God's assistance and permission, ther is a marryage shortly; intended to be had & solemynized betweene Thomas Sterling and Mary Brasseur, wid'w, late wife of Benjamin Brasseur; and whereas the said Mary Brasseur hath made her last will & testament in writing und'r her hand & seale, and therein & thereby disposed of most of the estate the said Benjamin dyed possessed of, amongst her children; now if the said marriage shall take effect, these may certifye to all those whom it any wayes concernes, that I, the said Thomas Sterling, for naturall love I beare unto the said Mary Brasseur, wid'w and out of affeccon to her children, doe grant, assigne, and sett over all the residue of the estate that was late the said Benjamin Brasseur's,.... (NOTE: The document goes on to say he relinquishes all rights to the property in favor of Benjamin and Mary's children)....

When Mary died, she left a will naming her children (Will Bk 1, pp. 187-89, 1663). She was known as Mary Brasseur, widow of the Clifts, because she lived on the Clifts of Chesapeake Bay. Those receiving property from her will are: CHILDREN: ROBERT - 200 acres, feather bed, rug, blankets, curtains, a servant, etc.; Benjamin - 200 acres, 2 cows, feather bed, rug, blankets, curtains, a servant, etc.; John - 200 acres, 2 cows, feather bed, rug, blankets, curtains, a servant, etc.; MARY - 600 acres, servant upon reaching 16 or marrying; 2 heifers; ANN - 2 heifers, servant upon reaching 16 or marrying; SUSANNAH - 2 heifers, servant upon reaching 16 or marrying; MARTHA - 2 heifers, servant upon reaching 16 or marrying; ELIZABETH - 3 heifers, servant upon reaching 16 or marrying. The girls were to have equal shares of 230 acres. Mary had sold 320 acres to her brother-in-law, Robert Brashear.

Benjamin Brasseur patented 300 acres at the head of Indian Creek, a branch of the western branch of Nanesmond River. Being due the said Benjamin by a former patent dated April 12, 1653. 26 Mch 1656 [Deed Bk 4, p. 40].

Benjamin and Robert Brashear where brothers who joined the French Hugenots (Protestants, protesting against the catholic Church). They left France to escape harrassment about 1637 and landed in the British Colony of Virginia the same year. Most of the settlers around them were British and Catholic and did not appreciate having French Hugenots in their mist. After about nineteen years, they moved on to the colony of Maryland in 1658, where both Benjamin and Robert died. Robert apparently didn't marry, or if he did marry, he didn't have children.

Robert Brashear, grandson of Benjamin, moved to North Carolina where he died after 1782, probably in what is now Guilford County. The next generation appears to have lived, for the most part in Guilford and Roane Counties of North Carolina.

Robert Brashear's grandson, Samuel Brashear, moved on west to an area that is now in Sullivan County, TN. He died there in 1829. The area was commonly known among the residents as "Squabble State" and is referred to as such in some documents. The name comes from the Colonies of Virginia, North Carolina and Tennessee each claiming ownership. Residents of the area gave each of the colonies as their place of residence at different times. Sullivan County was in North Carolina during the 1780's but became a part of Tennessee before the 1790 census was taken.

Five of Samuel Brashear's sons migrated to Kentucky. John Weslty B. Brashears was born 1805-1810, probably in "Squabble State" or Sullivan County, Tennessee. He gave his birthplace as Virginia on census records, and the age he gave would have him born in 1808; however, census records are known to have numerous errors.

John Wesley B. Brashear moved to Kentucky about 1837 and to Parker Co. Tx in 1854. Kentucky has many Brachear's in early day records. I suspect most of them are descendants of Samuel Brashears.

In 1790, Virginia included all of what is now Kentucky and West Virginia. The Kentucky and Tennessee boundary was not clearly established until 1859. Surveyors in 1779 made an error, known as the "Walker Line", and included the northern part of what is now Tennessee in Kentucky. Uncertain boundaries between counties, colonies, and later states, makes it important analyze the place of residence given in many early day records. "Squabble State" or Sullivan County, TN, is a good example.

Benois "Benjamin" ^ BRASSIEUR\\BRASSIER) of "The Cliffts"89,90,91 was born about 1621 at Pernes, Venaissin, France. Most sources list his birthdate as abt 1610, but since his parents were not married until 1621, this is impossible and IF he had been born in 1610, his father would have been 13 years old. He was living in 1658 in "Upper Bennett", Chesapeake Beach, Calvert County, Maryland. He was naturalized in 1662 in Calvert County, Maryland. Once Naturalized, his name was Anglicized to "Benjamin". He died before 1667 at Maryland. There is no documented proof other thanThe Brashear Story that proves Benois Brassieur is the son of Allemand DeJorcas Brasseur.

Charles Brashears believes that Benois father was Robert Brasseur who came to Virginia with at least seven children.

Information is allegedly also based on will and birth records in either Prince Georges Co. MD, probably South River Parish or Queen Anne Parish, or Calvert Co. All family data originates with the same base.

The name of Benois Brassier is spelled phoneticly. It is possible the original French spelling of Brasieur, Brassieur, in America became Brashears, Brazier, Besshears, Bresshers, Brasher, Brashar, Brashur, etc. French spelling is most likely Brassier or Brassieur, and the first name as Benois or Benoit, which later became Benjamin. It appears that the family in America usually adopted the spelling Brashear or Brashears. Benois Brassieur and his brother and/or father, Robert are believed to have come to the colony of Virginia and thence to Maryland as French Hugenot refugees by way of the Isle of Thanet, part of the county of Kent, bounded on the North and East by the North Sea amd South and West by the River Thour, off the Eastern shore of England. It is reported that this emigrant is listed in the records of the American Hugenot Society.

According to Charles Brashear there is still no evidence that Mary Richford was the wife of Benois, simply based on the fact that he paid passage for her. She came as an indentured servant, on an English ship. In some documents, written by Huguenots, she is referred to as "Marie", but in others she is more often referred to as "Mary." In her will she signed "MB", but after she married Robert Sterling, she signed a land record "MS". In 1790 when the 1st census of Md was taken there were 25 of the Brashears names listed as householders w/ their families & Slaves. Some later moved into Ps, Va, Ky, SC and other states. Benois has a patent of land of 300 acres at hts head of Indian Creek, a branck of the Wester Branch of Nansemond River, Md (Patent 4-12-1653, Valentine Papers-vol 1, pg 40) Benois and Mary had their will probated 5-23-1663.

Also on this date, a patent was issued to Benjamin Brasseur for three hundred acres on a "a creeke called Indian Creeke being a branch of Nansemum river" for the cost of transporting six persons into the colony."

Since Benjamin was given a patent it seems reasonable to assume that Robert and Benjamin were traveling together and that both of them had been in the colony before November 24, 1637. It is conceivable that Robert Brasseiur Sr. was the individual here earlier as Russ Williams contends and that both Robert Jr and Benjamin came later but my bet is with the brothers. Benjamin's patent was renewed and recorded again on March 26, 1656. It was an apparent precaution against litigation.

Benjamin's Citizenship papers state that

           "...Whereas Benojs rafseuir late of Virginia and subject of the Crowne of France haveing tranfported himselfe his wife and Children into this Crownes hereto inhabite hath besought us to grant him the said Benojs Brafseuir leave here to inhabite and as a free Dennizen freedome and to hime and his hieres to purchase Known ye that wee willing to give due encourgement to other subjects of thet Crowne doe hereby delcare them the said Benois Brafseuir his wife & children as well those allready borne as statehereafter to bee borne to bee free Dennizens of this our Province of Maryland..." signed Charles Calvert, December 4, 1662. Benjamin Brasseur dies barely a year after he is granted citizenship. Mary Brasseur, widow of The Clifts, files her last will and testament on 25 of May of 1663. In this she says that she sold 320 acres to her brother in law Robert Brasseur, gives 200 acres to her sons Robert, Benjamin and John. (Hall of Records of Maryland, Wills, Bk 1, pp.187-89).

This series of books is about descendants of Robert and Benois Brasseur, French Huguenot immigrants to Virginia, c1635, whose surname was Anglicized as Brashear. Over the years, many branches of the family added an "s" to make it Brashears. Benois Brasseur was naturalized in Calvert Co, MD, in 1662, and became known as Benjamin Brashear; he is the progenitor of virtually all Americans with surnames Brashear, Brashears, Brashares, Breshear(s), Breashear(s), Broshear(s), Beshear(s), Boshear(s), Beshires, often Brasher, Brashers, Brashier, Brashiers, sometimes Brazier, and about 35 other spellings.

The 1740s were an economically rough time in Maryland (some of our family lost their land and/or spent time in debtors' prison). Newly opened land in the Granville District of North Carolina was an invitation to a new start. Three Brashear brothers--Robert C., Basil, and Otho--migrated to NC in the late 1740s, early 1750s, where Robert and Basil got land grants. Basil went broke again and left about 1766, and Otho simply disappeared, but Robert C. Brashear and his wife, Charity Dowell, stayed on and (we think) prospered. They were patriots during the Revolutionary War, after which newly opening land in western places beckoned again, and the family succumbed to wanderlust or land-hunger; they became part of the American westward movement. This book traces the families of sons Philip, Asa, and Zaza, and daughter, Ann (Brashear) Ball; Robert Samuel Brashear and Jesse Brashears have to wait for vol. 3 and vol. 5, respectively.

Benoist Brassier anti 1629 anti 4-17-1663, m Mary. With father and brother, Robert, Jr. to Calvert Co, Maryland ca 1658. Family took up 1150 acres. 1660 name of Benoist Brassier anglicized to Benjamin Brashears. 1663 Benjamin made citizen of Maryland. Benoist sons with exception of Robert has no sons indeed no children.

BFB #106 May 94 Charlie Brashear. Originally "Brasseuir"; came w/ bro, Robert, (French Huguenots) to Va in 1653, m. to Mary 1658, Calvert Co. Benois Commissioned a Justice for co in 1661. 1662 Naturalized, name chg to Benjamin. At Benj's death wife Mary, had a pre-nuptial cont w/Thomas Starling, at same time recording her will and naming all her children by deceased husb. Bro Robert died w/o issue 1665. Each generation of Brashears has used a diff spelling of the French surname "Brasseuir" meaning "Lord of the Arm" or "Master by Right of Strength:" Old home place known as "Brashears Purchase", on the Patuxent River. The "Brashears" was a stage line for many years. Gen Lafayette dined at this house while on his way from Washington to Penn. The old house built of stone is still standing. An extract from the Albany Evening News, p 61, dated Mar 12, 1925, stated "The Pointed Firs" Brashear home at Castlelon-on-the-land & located at upper Marboro, capitol of Prince Georges Co, Md, where Benois (Benjamin) Brasheas was granted letters of denization (naturalization) by Cecil Calvert, (Lord Baltimore) on 1662. In 1790 when the 1st census of Md was taken theree were 25 of the Brashears names listed as householders w/ their families & slaves. Some later moved into Ps, Va, Ky, SC, and other states. Benois has a patent of land of 300 acres at hts head of Indian Crek, a branch of the Wester Branch of Nansemond River, Md (Patent 4-12-1653, Valentine Papers-vol 1, pg 40) Benois and Mary had their will probated 5-23-1663. Parents: Robert , Sr BRASHER and Florence BRASHER(U).

The Brashear family stems from French Huguenot immigrants, Robert and Benois Brasseur. The first record of Robert in VA is when he renewed a promissory note on 1 Jun 1636. Benois does not appear in the records of VA until 1653, when he received a 300-acre land grant, next to Robert Brasseur's 1200-acre grant, in Nansemond Co. Benois moved to Calvert Co, Md (not AACo) in 1658 and contracted to buy an 1150-acre plantation called "Upper Bennett." He died before this transaction was complete. Robert Brasseur's land in Nansemond Co, VA, went to his oldest surviving son in 1667, John Brasseur of Nansemond Co.

I, Mary Brasseur, widow of the Clifts, in the Province of Maryland, being of sound and perfect mind and memory, but knowing the uncertainty of this life, do make and ordaine this my last will and testament in manner and forme following: Imprimis [in the first place], for the natural love and affection I bear to my children and for their future maintenance and livelyhood, I give and bequeath to each of them as followeth; that is to say, two hundred acres of woodland to Robert, two hundred acres of the like land to Benjamin, and also two hundred acres of the like to John Brassures, my sons, the said land to come to them and either of them, their heires & assignes for ever, when they shall accomplish the age of one and twenty yeares; and in case any or either them shall depart this life before he or they shall attaine to his or their respective ages of one and twenty years, the land of him or them so dyeing shall remaine and be to the surviving brother or brothers; and my will and desire is that no timber trees shall be fallen for any use whatsoever on the said land until the said children shall come of age; but if they shall all depart this life before they shall attaine to their respective ages, then the said land to remaine and be to such daughter and daughters of me, the said Mary Brasshear, as shall then be living, the said six hundred acres of land being part of the land on which I now live, seituate at the Clifts, and bought by mee of Mr. Richard Bennett, merchant.

Item. I do also give and bequeath unto each of my sons above-named one feather bed, with the rug, blankets, curtains, and such like appurtenances to the same belonging.

Item. I give to each of my sons, when they shall attaine to their respective ages, one servant a peece.

Item. To Benjamin one cow, called the Wild Heifer, and another, called Goate; to my son John one heifer named Dainty, and one heifer named Starr, the said cowes and heifers, with their female encrease, to be delived to them at such time and when they shall attaine their several and respective ages aforementioned; and if any or either of them shall depart this life before they shall come of age, the said cattell, with their female encrease, to be equally divided between the surviving brothers; and my will and desire is that the two hundred acres of land that I have bequeathed to my son Robert shall be the two hundred acres which is next adjoining unto and on this side that parcell of land lately sold unto my brother in law Robt. Brasseur; and that Benjamin, my son, shall have his two hundred on this side of my son Robert; and that my son John shall have his next unto Benjamin's.

Item. I give and bequeath to my daughter Mary two heifers, called and known by the names of Pascoll and Phillpaill, with their female encrease, to be delivered to the said Mary when she shall accomplish the age of sixteene years or day of marriage, which shall first happen. Also, I give and bequeath to my daughter Ann two heifers, called and known by the names of Ioneeasy and Sarah, with their female encrease, to be delivered to her when she shall accomplish the age of sixteen years or day of marriage, which shall first happen; also I give and bequeath to my daughter Susannah two heifers, called and known by the names of Fancy and Pye, with their female encrease, to be delivered unto her when she shall accomplish the age of sixteene yeares or day of marriage, which shall first happen; also I give and bequeath to my daughter Martha three heifers, called and known by the names of Brouning, Primrose & Roase, with their female encrease, to be delivered unto her at such time and when she shall accomplish the age of sixteen years or day of marriage, which shall first happen; also I give and bequeath to my daughter Elizabeth three heifers, called and known by the names of Christmas, Cole and Nutt, with their female encrease, to be delivered unto her at such time and when she shall accomplish the age of sixteen years or day of marriage, which shall first happen; and in case either of my said daughters shall depart this life before they shall accomplish their severall and respective ages, then the cattle, with their encrease, of her or them so dyeing to remaine and be and equally to be divided amongst the surviving daughters.

Item. I give my five daughters each of them a servant to be delivered them at the age of sixteene yeares or day of marriage, which shall first happen. As for that part of my estate that I shall have at my decease and not herein and hereby already given and bequeathed, I give and bequeath to my daughters, equally to be divided between them, share and share alike, to be delivered them at such time and when as they shall accomplish their several ages or days of marriage, which shall first happen. And my will and desire is that if I depart this life before my children come of age, the overseers of this, my will, take care that my children shall peaceably and quietly enjoy the plantaçon I now live on, with all appurtenances whatsoever, without the lett or molestaçon of any person or persons whatsoever until they shall accomplish their severall and respective ages or days of marriage, which shall first happen. And I nominate and constitute my loveing friends, Thomas Sterling, and Robert Brasseur, my brother-in-law, to be overseers of this, my last will and testament, desireing them in all things to see it carefully performed; and I publish and pronounce it to be the absolute last will and testament of mee, Mary Brasseur.

IN WITNESS whereof, I have hereunto sett my hand and seale, May the five and twenty, one thousand six hundred sixty and three. The marke of Mary [ MB ] Brasseur Signed and sealed as the last will and testament of the said Mary Brasseur in the presence of: Theophilus Lewis, James Pugslep (MdHR Wills, Bk 1, pp.187-89).

Two months after her will, which was apparently made to protect her children with Benois Brasseur, Mary Brasseur, Widow of the Clifts, filed a prenuptial contract with Thomas Sterling, with whom she planned to marry, that relinquished all claims he might have to any part of her estate:

WHEREAS by God's assistance and permission, ther is a marryage shortly intended to be had & solemnized between Thomas Sterling and Mary Brasseur, wid'w, late wife of Benjamin Brasseur; and whereas the said Mary Brasseur hath made her last will & testament in [ ? ] writing und'r her hand and seale, and therein & thereby disposed of most of the estate the said Benjamin dyed possessed of, amongst her children; now if the said marriage shall take effect, these may certifye [to] all those whom it any wayes concernes that I, the said Thomas Sterling, for naturall love I beare unto the said Mary Brasseur, wid'w, and out of affecçon to her children, doe grant, assigne, and sett over all the residue of the estate that was late the said Benjamin Brasseur's, that I shall dye possessed of, as cattle, hoggs, houses, land, household stuffs, and whatever else the said Mary Brasseur hath not given nor bequeathed in her last will and testament unto Robert Brasseur, her brother-in-law, to and for the sole onely proper use, benefitt, and behoofe of the daughters of the said Mary, equally to be divided betwixt them as they shall attaine to theire severall & repective ages or days of maryage, which shall first happen; and that they shall bee and remaine peaceably att the new plantaçon of the said Mary Brasseur till such times as they come of age or are maryed, according to the tenor & effect of the said Maryes will, without the lett, disturbances or molestaçon of mee, the said Thomas Sterling, or any one from, by, or und'r mee. And I furthermore promise that the said Mary Brasseur shall dispose as she will her selfe of the 10,000 lbs of tobacco due from Robert Brasseur upon bill, as witness my hand. (MdHR, Testamentary Proceedings, Book 1, pp.126-27. Copy in Back and Brashear, The Brashear Story, p.15-16.)

Author Charles Brashear relates: The 10,000 pounds of tobacco was the purchase price of the 320 acres. But brother-in-law Robert died 5 Dec 1665, before it could be paid; in 1666, his will was being argued in court. Mary Brasseur died about the same time; her will entered probate in 1668. On 2 Aug 1663, Benjamin's widow, Mary, who had married Thomas Sterling after 25 Jul 1663, registered:

A list of rights due Mrs. Mary Sterling never entered upon record or land taken up for them, viz ... Benjamin Brashear Sen, Mary Brashier Sen, Robert Brashier Jun, Benjamin Brashier Jun, John Brashier, Ann Brashiers, Susanna Brashier, Martha Brashier, Elizabeth Brashier, Thomas Sterling, Edmond Joyce, Joseph Owen, transported Anno 1661 ... John Selman, Andrew Munrow, Mary Tire, Thomas Smith, Thos Frost, George Davison, John Morgan, William Whitehead, Robert Jarvis, John Cheney, James Polley, Alice Woodyard, Robert Welk (or Webb), Nathan Daw, Robert Brashier Sen, Thomas Morgan..... Know all men by these presents that I Thomas Sterling and Mary my wife have assigned unto Thomas Trueman all our right and title of thirteen of those rights of land first mentioned, as witness our hands this 2 of August 1663. /s/ Thomas Sterling /s/ M S [her mark] Witness: Robert Brashier. Benois Brasseur and his brother Robert arrived in Kent, England probably about 1640 where Benois met and married his wife, Mary Richford. The family left England and arrived in Virginia in 1653. In 1658, they moved to Calvert County, Maryland where they established a residence. Benois was commissioned as a justice in Calvert County in 1661. In 1663, Benois was naturalized as a former citizen of France and Anglicized his name to Benjamin Brashear. Benjamin (Benois) died shortly after his naturalization in May 1663.

Mary Richford Brashear's will was recorded in 1663 along with a prenuptial contract with Thomas Starling, who she intended to marry. In the will, she names her three sons - Robert, Benjamin, and John - and five daughters - Mary, Anne, Susannah, Martha, and Elizabeth.
