There is a great and necessary power in the hands of the Judges of the Native Land Court. To them a mere stroke of the pen, a misinterpretation of a clause of an Act — or — if they are of a sluggish mind, susceptible of flattery, and led away by ad captandum arguments — anyone one of these is sufficient to cause or to perpetuate grave errors inflicting on unfortunate suitors endless litigation, and, what is synonymous therewith, utter ruination. As a slight illustration of what we mean, mention may be made made of a recent sub-division award made by Judge Halse in the case of the Matawhero No. 1 Block. His Honor Judge Halse, filled no doubt with the laudable ambition of desiring to excel all his predecessors in the matter of partitioning lands in this district, made what might be termed a judicial raid upon several of the most valuable blocks of land in the Bay. Columbus solving before the philosophers the knotty problem of balancing an egg by cracking one of the ends, can scarcely give an adequate idea of the ease with which Judge Halse could sub-divide the whole Island. The difficulties that have exercised the minds of different Legislatures in different parts of the world, off and on for the last two or three hundred years, of providing suitable laws for partitioning lands held by joint tenancy, tenancy in common, and co-parceners, faded away like the morning dew. Now, Hirini Haereone and his wife Peti Moreti are owners in the block above named, holding between them under a conveyance from the late Captain Read one hundred acres. Unfortunately for them Matawhero No. 1 was subdivided — that is to say, the whole of the block iucluding Hirini Haereone, and his wife's hundred acres (excepting a small portion for Wl Haronga) was awarded in fee simple to the trustees of the late Captain Read. The certificate was forwarded by Judge Halse in accordance with the 93rd section of " The Native Land Act, 1873," to the Registry of Deeds office, Napier, and was registered. Such registration having in the words of the Act, the same effect as if the Crown Grant had defined such share and such portions of land." Thus we see the unintentional injustice that has been inflicted upon Hirini Haereone and his wife. They are now involved in an action in the Supreme Court, to recover their property from persons who apparently have the legal estate vested in them by the Crown.
